BSE Liability Waiver

Acknowledgment and Assumption of Risk 

I acknowledge that participation in BSE’s programs and activities involves certain inherent risks, including but not limited to, the risk of injury, emotional distress, or other unforeseen consequences that may arise from participation. I understand that these risks are part of the nature of the activities and I voluntarily assume all such risks.

Release and Waiver of Liability 

In consideration of being allowed to participate in BSE’s programs, I hereby release, waive, discharge, and covenant not to sue Broad Spectrum Education, its officers, directors, employees, agents, and volunteers (collectively referred to as "Releasees") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by the participant, or to any property belonging to the participant, whether caused by the negligence of the Releasees or otherwise, while participating in such activities, or while in, on, or upon the premises where the activities are being conducted.

Indemnification 

I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including court costs and attorneys’ fees, that they may incur due to the participant’s involvement in BSE’s programs, whether caused by the negligence of the Releasees or otherwise.

Medical Treatment 

I understand that BSE does not provide health care services or mental health therapy. In the event of an emergency, I authorize BSE to seek emergency medical treatment for the participant if necessary. I understand that I will be responsible for any medical expenses incurred.

Use of Personal Information 

I consent to the use of the participant’s image, name, and likeness in any educational or promotional materials produced by BSE. I also consent to the collection and use of personal information provided in this form for the purposes of administering BSE’s programs and services.

Acknowledgment of Educational Therapy 

I acknowledge that the educational therapy provided by BSE is a form of mindful academic counseling aimed at improving academic skills and performance. It is not a substitute for professional medical advice, diagnosis, or treatment. I understand that BSE’s services do not include mental health therapy or health care services.

Severability 

If any term or provision of this Liability Waiver is held to be invalid, illegal, or unenforceable, the remaining terms and provisions shall continue in full force and effect.

Governing Law 

This Liability Waiver shall be governed by and construed in accordance with the laws of the state of New York, without regard to its conflict of laws principles.

Acknowledgment of Understanding 

I have read this Liability Waiver, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue the Releasees. By checking the box below, I acknowledge that I am signing this waiver freely and voluntarily, and intend by my signature to provide a complete and unconditional release of all liability to the greatest extent allowed by law.
